Ask the Lawyer - Managing Legal Marijuana
Synopsis of this Presentation:
Recent passage of AB132 prohibiting drug testing for applicants for most positions warrant a revisit to all policies and procedures used by HR to manage Legal Marijuana in a state like Nevada where marijuana is legal for both recreational and medicinal use while its use remains illegal under federal law and for organizations covered by the Federal Drug Free Workplace Act. This program lists the Do’s and Don’ts for HR practitioners who must comply with sometimes conflicting regulations.
Participants will Learn:
- What does AB132 require
- How should HR manage employees who partake in recreational marijuana
- How should HR manage employees who must use medicinal marijuana
- How do collective bargaining agreement provisions effect HR’s policies and practices regarding legal marijuana
- How does the Federal Drug Free Workplace affect your situation
- How to draft your marijuana policies and procedures
- How to tell if your employees are under the influence of alcohol or marijuana
- Are employees who use legal medical marijuana subject to discipline for being under the influence?
- Are employers required by state Workers Compensation law to provide marijuana for employees who have medical marijuana cards?
